The Guardianship
From Belief to Practice
After completing the study of divine oneness, prophethood, imamate, and the Mahdi (aj), the believer moves from mental assent to practical compliance; jurisprudence is the program that transforms creed into conduct and shapes the spirit and the deed in accordance with the will of Allah.
From Belief to Practice
After the pillars of the doctrinal system settled in our previous studies, and the epistemic structure was completed — beginning with the establishment of divine oneness and the qualities of the Wise God, passing through the necessity of the message and the infallibility of the prophets, and arriving at the inevitability of the imamate and the divine extension embodied in the existence of Imam al-Mahdi (aj) and his occultation — the researcher and the believer stand before a decisive epistemic and practical entitlement: what is the next step?
Creed is not merely abstract ideas stored in minds, nor is it philosophical theories debated behind closed doors. The loftiest purpose of establishing this divine channel extending from heaven to earth — that is, the Messenger (PBUHPBUH — pronounced ‘sal-lal-LAAH-u alayhi wa aalih’ — صلى الله عليه وآله Peace and blessings be upon him and his family. This expression is used after mentioning Prophet Muhammad (PBUH) as an act of reverence and obedience to the Quranic command to send blessings upon him.) and the Imams (ASAS — pronounced ‘alayhi as-salaam’ — عليه السلام AS stands for “peace be upon him / her / them.” It is the English abbreviation of the Arabic expression “alayhi / alayha / alayhim as-salam.” This expression is used after mentioning prophets (AS), the Imams (AS), Lady Fatima (AS), Sayyida Zaynab (AS), Lady Khadijah (AS), and Ahl al-Bayt (AS) as a sign of respect.) — is dynamic application in the reality of the human being. This infallible system is the channel and the means that Allah, glorified and exalted, transmitted so that we may take from it our vital program, and realize through it the perfective purpose that Allah willed for us when He created us and made us vicegerents on His earth.
From here, the door opens, in its specialty, upon the science of Islamic jurisprudenceIslamic jurisprudence — pronounced ‘fik-h’ — الفقه The Arabic term is Fiqh. It is the disciplined study of deriving practical religious rulings from the Quran, the Sunnah, reason, and recognized legal principles. It covers worship, purity, family life, transactions, social responsibilities, and the practical expression of belief. in its comprehensive integrative sense, as the applied code and the practical program that transforms creed into movement, elevates the human spirit, and binds it to the Absolute.
1. Jurisprudence Is the Applied Code of the Doctrinal Objectives
We established earlier that Allah, glorified is He, is Wise, and that His acts and commands are grounded in the fateful purposes for the perfection of the human being. Based on this, the rulings and legislations were not sent down arbitrarily, nor for the sake of mere formal control; they are the requirement of this divine wisdom.
Creed Is Like the Root and Jurisprudence Like the Fruit
If creed is the fixed root in the depths of the self, then Islamic jurisprudenceIslamic jurisprudence — pronounced ‘fik-h’ — الفقه The Arabic term is Fiqh. It is the disciplined study of deriving practical religious rulings from the Quran, the Sunnah, reason, and recognized legal principles. It covers worship, purity, family life, transactions, social responsibilities, and the practical expression of belief. is the fruit and the leaves that appear on the human being’s limbs and conduct. A root cannot grow and yield its harvest without practical branches, and branches cannot stand without a solid doctrinal root.
The Link Between Legislation and Existence
The jurisprudential rulings — of acts of worship, transactions, and systems — are in reality spiritual and existential laws parallel to the natural laws. Just as the body needs the laws of physics and biology to move and grow, the human spirit needs the jurisprudential laws to attain perfection and to be freed from the captivity of matter and base desire.
2. Elevating the Spirit: The Spiritual and Moral Dimensions of Jurisprudential Practice
It is a grave epistemic error to confine Islamic jurisprudenceIslamic jurisprudence — pronounced ‘fik-h’ — الفقه The Arabic term is Fiqh. Jurisprudence in the school of the the Prophet's householdthe Prophet's household — pronounced ‘Ahl al-Bayt’ — أهل البيت (ع) Pronounced: Ahl al-Bayt. Literally “the People of the House.” On this website, according to the understanding followed here, this term refers specifically to the Fourteen Infallibles (AS): Prophet Muhammad (PBUH), Lady Fatima (AS), Imam Ali (AS), Imam Hasan (AS), Imam Husayn (AS), and the nine purified Imams (AS) from the descendants of Imam Husayn (AS), ending with Imam al-Mahdi (AS). It does not simply mean every relative, every spouse, or the whole extended family. (ASAS — pronounced ‘alayhi as-salaam’ — عليه السلام AS stands for “peace be upon him / her / them.” It is the English abbreviation of the Arabic expression “alayhi / alayha / alayhim as-salam.” This expression is used after mentioning prophets (AS), the Imams (AS), Lady Fatima (AS), Sayyida Zaynab (AS), Lady Khadijah (AS), and Ahl al-Bayt (AS) as a sign of respect.) is an instrument for elevating and purifying the spirit, and this shaping manifests in two correlated dimensions.
First: The Practical and Behavioral Aspect
The human being’s adherence to the daily jurisprudential program represents a conscious training of the human self. Standing in prayer, abstaining from food, drink, and forbidden things in fasting, and disciplining financial transactions according to the scales of justice and integrity — all of these are practical exercises that move the human being from the randomness of instinct to the discipline of obedience.
This practical discipline is the first step toward purifying the outer, and without purifying the outer the spirit cannot ascend the degrees of perfection.
Second: The Moral Aspect and the Cultivation of the Self
Jurisprudence is existentially linked to morals and the purification of the inner; every practical jurisprudential ruling carries in its essence a moral, cultivating purpose:
- Prayer: is not merely movements; it is an instrument for combating arrogance and vanity in the self. The Exalted said:
“It forbids indecency and wrongdoing.” (Al-Ankabut: 45)
- Charity, alms (zakat), and the fifth (khums): are not financial collection; they are a process of emptying and purifying the self of the miserliness of matter and the greed of possession. The Exalted said:
“Take from their wealth a charity by which you purify them and cause them to grow.” (Al-Tawba: 103)
- Fasting: is a training in patience, in restraining the reins of desire, and in rising above base things.
Jurisprudence, in this inner sense, is what leads the process of cultivating the self; it transforms abstract moral concepts — such as justice, patience, humility, and altruism — into lived daily behaviors that the responsible person practices, which necessarily leads to polishing the mirror of the spirit so that it may receive the divine effusion and the guiding light.
3. The Role of Jurisprudence in the Age of Occultation: Safeguarding the Extension and Preserving Identity
When we reach the age of occultation — the age of the veiling of Imam al-Mahdi (aj) in his title — the epistemic question arises concerning how to receive this program and apply it. Here the role of jurisprudence and the office of the jurist manifests as the greatest apparatus of safeguarding and preservation that the school of the the Prophet's householdthe Prophet's household — pronounced ‘Ahl al-Bayt’ — أهل البيت (ع) Pronounced: Ahl al-Bayt. The Epistemic Extension Through Narration and Reasoning
The absence of the Imam (aj) in his body and person did not mean the cutting off of his Sharia and his perfective program. The pure Imams (ASAS — pronounced ‘alayhi as-salaam’ — عليه السلام AS stands for “peace be upon him / her / them.” It is the English abbreviation of the Arabic expression “alayhi / alayha / alayhim as-salam.” This expression is used after mentioning prophets (AS), the Imams (AS), Lady Fatima (AS), Sayyida Zaynab (AS), Lady Khadijah (AS), and Ahl al-Bayt (AS) as a sign of respect.) laid down general rules and commanded the nation to refer to the narrators of their hadith and the jurists who preserve their religion and oppose their own caprices.
Preserving the Social and Legal Order
Jurisprudence represents the epistemic rock upon which the attempts to dilute or distort religion across the centuries are shattered; it is what preserves the identity of the believing society, and provides the legal and practical answers to all developments and calamities, preventing the nation from floundering in the darknesses of deficient human opinions or falling into the trap of subservience to man-made systems.
A Prelude to the Coming Stage
Belief in divine oneness, prophethood, the imamate, and the Mahdi (aj) places us directly before the responsibility of compliance and action; the divine channel has been transmitted, the texts and rulings have been preserved, and the human being no longer has an excuse for lagging behind the caravan of perfection.
Jurisprudence is the bridge that carries us from the space of mental assent to the space of actual realization, and it is the purifying instrument that elevates our spirits and shapes our individual and social conduct in accordance with the will of Allah and His good pleasure. Based on this methodical rooting, we will proceed in the coming studies to clarify this jurisprudential program and its direct effect in shaping the perfect human being and the just society, in fulfillment of the divine purposes.
Creed is not an idea preserved in the mind; it is a root that wants to appear in the deed. And Islamic jurisprudence is the bridge from assent to realization.
